@Mona, this is the flagged down video www.youtube.com which now states why it was flagged. This attribution page shows it was on my account : www.youtube.com You can always swap a video ID into that attribution URL to find where a removed video was posted.

@lilly, yeah, apart from my bellyaching here I've hardly responded as most people would to such an egregious flagging in blatant violation of Fair Use. But I'm way busy at the moment with a half dozen projects I can't keep up with and there's a remote possibility that it wasn't Fukushima Central Television that did this, so I'm hesitant to be pushed by the shock of the flag into making reaction video with the accusation before I get confirmation of what's going on. So maybe I should contact them FCT directly. If it really was them, my feeling is a lawsuit should be done even if they don't respond and youtube reinstates my video, because I'd like to see a court judgement that says Fair Use law applies to commentary on Fukushima.

@Elaine, the US copyright law for Fair Use gives no 'fear and panic' provision www.copyright.gov I don't know about Japan, but they can't impose Japanese law on US citizens or on youtube. If you can't use 18-second clips of historic events for commentary and analysis, Fair Use doesn't exist! If this isn't Fair Use, nothing could be! The footage isn't even of a creative production like art or music, but of an event that itself is not a copyright of anyone.

@Ian Ian, I had a video uploded, that i re encoded, it got flagged as well......I uploaded the same video on FB and no one said anything.....It was positive and i even linked to original donations site.rember Quakebook?.........
I thin k, there has to be individuals opinionated rather than fiar use policy, that are doing the flagging.......Hell, our Twitter account got shut down for 5 days, i responded and they finally apologized......I also explained, that this is fair use and we made it a point, to NOT spread rumors nor false info ........

Interesting to consider that there's first- and second-order copyright. A musician can own the copyright to the notation of a song (first order) and to n number of records of it (second order). Whereas a photographer can own copyright to a photo of the US Capitol (first order) but not to the design of US Capitol itself (no second-order copyright). So the Fukushima footage is at best the weaker first-order copyright, and even second-order cases are subject to Fair U

@Veenie, youtube is giving FCT 10-14 days to responds, at which time I'm hoping youtube itself will make a Fair Use determination. But een if they do, it would be nice to have a court judgement as FCT can just do this at will, shutting one down for a couple weeks if you show the explosions for commentary thereupon.

@Edano, but most of the high-view videos of the explosions are flagged down. I wish I could search this forum since a couple months ago I posted a list of flagged Unit-3 videos. Otherwise, it's almost impossible to show that this has been happening since flagged video thumbnails disappeal and only if there was a link saving the URL do you have a trace. It's my recall that FCT was the claimant in the other flags.
